This posting shows (and I will prove this in my next posting when I publish the official documents , as written by Prokipczak himself, and translations of them), how Inspektor Piotr Prokipczak violated Polish law, violated his duty and acted outside of all legal authority following Piotrs' brutal death. His appalling actions, dereliction of duty, violation of law and Procedure as required under the Polish Criminal Code are directly responsible for Piotr never receiving Justice, and the abuse and attacks I have suffered.
His actions led directly to Oliwia Oleksyks' false accusations of me being guilty of both attacking her, and of murdering my own beautiful child, that false allegation being treated by Police and Prosecutors as fact from the moment of Piotrs' death. It is his shocking, unlawful conduct, that led to a national news report on TVP Krakow following Piotrs' brutal death, in which "the Irishman" ,and since I was the only Irishman, (and 1 of 2 foreigners in a city of 35,000) was clearly and wrongly identified as being guilty of violence against Oliwia Oleksyk resulting in a "tragedy in Gorlice". (I will upload this newsbroadcast later in this blog.) It was his actions that led to a shameful witchhunt against me for murdering my own child, but also ensured no investigation into the cause of Piotrs death was ever carried out.
In my next posting I will explain how Polands' "Justice" system has never investigated Piotrs' death, rather a witchhunt, based entirely on Oliwia Oleksyks' perjury and Inspektor Prokipczaks false report and violation of law, was conducted, aimed at framing me for Piotrs' murder, and when that led no-where other than to irrefutable proof that Oliwia Oleksyk had lied, and that no such crime was ever committed by me, the case was quietly dropped, and Piotrs' brutal death was simply forgotten. In short, The polish state, through Inspektor Prokipczak and his ilk, wanted to get me, and when it could not achieve this aim, the death of an innocent child became an inconvenince best forgotten, as to investigate properly would expose to the world the corruption, incompetence, and violation and dereliction of duty of both Police and Prosecutors- a revelation that would never be permitted to happen in Poland.
Firstly, I must quote to you Article 209 of the Polish Criminal Procedure code, as it refers specifically to what MUST be done by the State authorities following a suspicious/violent death. The law is very clear as to who has legal authority to carry out these duties, and therefore anyone not specifically mentioned in the law has no legal authority whatsoever to carry out any legal or supervisory activity in relation to that death.
Article 209 p1 code of criminal procedure
In a case where the death may have been caused by a criminal act, an examination of the corpse and a post mortem shall be conducted.
Article 209 p2 code of criminal procedure
The examination of the corpse shall be conducted either by a Prosecutor, or by the Court in Court proceedings, with a pathologist attending, if possible, specialized in forensic medicine. In urgent cases, the examination is done by the Police with an obligation to notify a Prosecutor without delay.
So, in simple and practical terms, under Article 209 p1 of Polish law, a body may be examined in situ by Police, if that is deemed urgent, in all other situations either a prosecutor or a Judge must view and examine the corpse as it is found. No such examination was ever carried out on Piotrs' dead body in the delivery room of Gorlice Hospital. Piotr died on the 28th March 2009, as can be read in Inspektor Prokipczaks' note, he was not informed of the death until 2 days later, the 30th March 2009 - therefore no such possible urgency existed.
Artical 209 p4 code of criminal procedure
A post mortem shall be conducted by a Pathologist, with the Prosecutor or the Court present. In Court proceedings, the provisions of Art 396 p's 1 and 4 shall be applied correspondingly.
Simply, under this Article of Polish law, either a Prosecutor from Gorlice Prosecutors' office (Prokurator Rejonowy w Gorlicach), or a Judge from Gorlice criminal Courts' division (Sadu Sejonowy), were legally obliged to attend Piotrs' post mortem when it was conducted by Dr Henryk Boloz. No-one else had the legal authority to attend at the post mortem in a supervisory, investigatory or Judicial capacity. In short, Inspektor Piotr Prokipczak unlawfully, and without authority from the State, attended Piotrs' post mortem. He then filed a report which contained false information regarding a "beating" that had never occurred.
In practice, it is the Prosecutors day to day function to attend the Post mortem, not the Judges', which begs the question as to why Prosecutors failed to do their duty, and permitted Inspektor Prokipczak to violate the law, which has had such devastating consequences.
Why was Inspektor Prokipczak present at Piotrs' post-mortem? What motivated him to attend a post-mortem when having no legal entitlement to do so? Who sent him there? Why did no Prosecutor from Gorlice Prosecutors office attend the post mortem as required by law? Why did no senior Police officer nor Prosecutor take any action against Inspektor Prokipczak for his actions?
I, today, am putting these question to the Polish Attorney General, (Prokurator Generalny) Andrzej Seremet, Komandant Gawlik of Police in Gorlice and the Chief Prosecutor of the Prosecutors office in Gorlice, and will post their response, if a miracle should happen and I get one, on the blog.
Inspektor Piotr Prokipczak did not let little things like the Laws of Poland, nor his lawful duties concern him, he without legal authority nor legal entitlement attended Piotrs' post mortem, and then put untrue and unchecked false information in his report, information that was to destroy my hopes of Justice for my son Piotr, and lead to me being branded a violent, woman beating, murderer in the media and on the streets of Gorlice
It is because of this incompetent, unprofessional, arrogant, violent, drunken pathetic Inspektor of Police Piotr Prokipczak, that I have had to fight for justice for my son and for myself, for the past 4 years. a fight that continues.
I ask you to read my next post, as there I will post the original report (pages 1 and 2), (pages 3,4 and 5 will be English language versions of the document), written by Prokipczak on the 31st March 2009 following Piotrs' murder. In it Inspektor Prokipczak describes being notified of the death and going to Piotrs' post-mortem with a police photographer. He also refers to "THE BEATING" that was inflicted on Oliwia Oleksyk. NO such beating ever happened, as proven by the fact that I was never even spoken to by the Police and the 6 separate medical reports stating that, not alone did I never beat Oliwia Oleksyk, but more, the beatings she claimed could never, did never, take place, it was an invention in her sick twisted mind in an attempt to blackmail me and frame me for murder, but Prokipczak did not bother to ascertain these facts, he just wrote the false information in his report, as though it WAS fact. In being so lazy, so incompetent, so ignorant of law, duty and morality, he set in motion the events that have continued to this day.
I, in my next posting will reveal details of more of Inspektor Prokipczaks' abuse of process, will post his "official note" with translation, plus elements of a Doctors Statement that prove the lie of Prokipczaks false assertions. And in later posts will give the full details of his violent drunken attack on me some months after Piotrs' brutal death.
And again, his Boss' cover up through bizarre "explanations" of why nothing will be done to prosecute Prokipczak.
